1. These terms of service are binding for the use of our online-forum service at www.boardprovide.com, www.boardprovide.de and www.boardserver.net (called "BoardProvide"), which is operated by WENEXT Internet Broadcasting Maximilian Wegner (called "WENEXT") and used by the user of the system (called "User").

1a) These terms are binding for the User and WENEXT in the official German version. This version is a translation, that shall only help you to understand the meaning.
1b) The user can access the current terms of service at www.boardprovide.com/terms.hs (English) and www.boardprovide.de/terms.hs (German) and print it out for his documents.

2. By clicking "I Agree to the terms of service" the user accepts this terms of service completely, and confirms that he read and understood them.

3. All forums, accessible by the forenamed domains, are also part of this terms of service.

4. The use of our service is free for the user.

5. To sign up at BoardProvide correct details are needed. These details won’t be given to thirds, and will be saved by WENEXT to run your forums properly.

6. The user has the right to get information about his saved data. Please also read our privacy policy (German) at www.wenext.net/backend/privacy.php

7. All services are exemptible. WENEXT reserves the right to deactivate or delete certain forums, and to exclude Users from their service.

8. If a user violates these terms of service his forum will be deactived or deleted without announcement. The user has 14 days to contradict by e-mail, fax or post mail.

9. The user guarantees that he will keep his login details secure, and that he won’t give it to thirds.

10. The user has the right to delete his forum and all stored data. Therefore he needs to ask WENEXT by fax or post-mail.

11. Changes in the personal data (e.g. new e-mail address) must be changed at BoardProvide immediately. Users and forums with wrong details will be deleted after 14 days.

12. If a forum is not used for longer than a year (no logins, no posts) BoardProvide reserves the right to delete the forum within 14 days. The user will be notified about that.

13. The user is fully responsible for the contents of his forum. He has the possibility to delete contents in his forum, and to check them before they get published (moderation). WENEXT gives the user the technical possibility to delete term-violating data, before they get public.

14. The user will not publish any of the following forbidden contents in his forum:

14a) Contents, that are violating German law or general moral values,
14b) Publishing or hyperlinks to illegal Contents as Warez, Cracks, illegal audio and video contents,
14c) radical, racist, discriminatory or very violent contents,
14d) porn or erotic content,
14e) Contents, that violate rights of thirds,
14f) Spam, excessive advertisements, "flooding".

15. WENEXT reserves the right to run advertisements in the forums. The user is forbidden to run own advertisements, or to manipulate the advertisements of BoardProvide.

16. The common duty of care is to take notice of.

17. WENEXT reserves the right to change this terms of service. The user will be notified about any changes, and has the possibility to contradict by fax or post-mail within 7 days.

18. Any costs that result from violating these terms are to be paid by the user.

19. WENEXT is not responsible for the contents in the user’s forums. The legal liability behoves to the user, because he has the possibility to check the contents before they get public.

20. Backups are made regularly. Nevertheless WENEXT cannot be liable for loss of data, because BoardProvide is a free service. But WENEXT will do everything technically possible to save your data, and to notify the user immediately.

21. Venue is Mainz, Germany.

22. The inoperativeness of one or several provisions of said terms of service does not affect the validity of the remaining provisions. In such case a provision is applicable which meets best the legal and economic aim of the inoperative provision. This does not apply in case complying with the terms of the Contract would constitute unreasonable hardship for one or both of the Parties.
